FULL TRANSCRIPT
Sir, I have moved an opposition to this Bill which is called The Constitution (126th Amendment) Bill, 2019.
Sir, yeh Bill mein humara Sangvidhan rachna hone ke samay jo Articles 333 aur 334 the, jaha par Anglo Indians ke liye sangrakshan rakha gaya tha, woh bandh kiya jaa raha hain. Jo Ambedkar saab kiye the, Jawaharlal Nehru kiye the, ab sarkar ko achanak dhyan mein aya ki isko abolish karna chahiye. Anglo Indians ke do seats Lok Sabha mein hota hain aur 9 seats Vidhan Sabha mein hota hain; woh nahin rahna chahiye. Jo Article 334 mein hain, ki 70 saal tak Anglo-Indians ko sangrakshan mile, usko abolish kiya ja raha hain.
Is liye Sir, I have given a Notice opposing this The Constitution (126th Amendment) Bill, 2019, under Rule 72 (1) of Rules and Procedures. I beg to oppose the introduction of The Constitution (126th Amendment) Bill, 2019, due to its unconstitutional nature. This Bill is in violation of Article 14, which talks of equality before law and which provides against arbitrariness and requires a classification to be based on some real and substantial distinctions.
The current Bill extends different treatments to different minority communities, namely SC/ST and Anglo-Indians. Both have reservations under Article 334. This difference is being exercised arbitrarily without relying on any real facts or data. The Bill is also an attack on the principle of federalism as it deprives the states of the power of appointing members from the Anglo-Indian community.
Yeh 70 saal jo chala hain aaj ek community ko representation aap raat-o-raat abolish kar denge, yeh sahi nahi hoga, fair nahi hoga. Toh main Mantriji ko kahunga ki isko withdraw kiya jai. Dr Ambedkar aur Jawaharlal Nehru-ne jo reservation diya tha Anglo-Indian ke liye, chotha minority hain, usko rakhna chahiye
