Sir, I rise to speak on what I consider to be, perhaps, the most fundamental responsibility of any civilized State – the justice delivery system. The Bill is not about four more Judges. It is about whether the Parliament has courage to confront the deeper crisis of India’s justice delivery system. The importance of sound justice delivery system cannot be overstated because people believe disputes would be resolved fairly. Justice has always been the bedrock of any society. Not only in present society or a democratic form of governance, but in tribal societies also, the justice delivery was the main thing which kept the society together. Let us not confuse judiciary with the justice delivery system. That is the mistake we are making here today. We are thinking, if we are increasing Judges, it will increase the justice delivery system.…(Interruptions)… If people will not get justice..…(Interruptions)…
If people will not get justice, we will not be able to function as a society. It is very important. It is one of the most important things – justice. I had been a police officer for 35 years. Let us not close our eyes to reality. What we see is, lot of complaints.
Police station mein bahut saari complaints aati hain, jinmein cheque bounce ka case, contract violation ka case, family matters, saari cheezen aati hain. Ye isliye nahin aati hain ki unko police par vishwas hai. Unko police par vishwas nahin hai, lekin justice delivery system par usse bhi kam vishwas hai, isliye ve courts mein nahin jaate hain. Unko maalum hai ki hum court mein chale gaye, to shayad unke pote ko result milega.
Sir, I am grateful to the Supreme Court, the collective Supreme Court. Un logon ne to jaise apna collegium system kar rakha hai, apne aap khud niyukti karne ka, vah world mein kahin bhi nahin hai. Ve apne aap 4 judges badha sakte the. Unhone hum logon ka samman rakha, iske liye main unko bahut dhanyavaad deta hoon.
Sir, House mein hum logon ko yeh sochna hai ki House has no shortage of intellect; House has no shortage of scholarship and no shortage of experience, what we need is constitutional courage. Ye jo teen pillars hain – Executive hai, Parliament hai aur Judiciary hai, in teeno ko apne framework mein rehkar kaam karna hai. Hum logon ne, Parliament ne especially I would say, we have abdicated our responsibility. Sir, we have to put limits. We have to have checks and balances there.
Sir, what does India need! India does not need more Judges. India needs faster justice; India needs affordable justice; India needs predictable justice; and India needs accessible justice.
