Sukhendu Sekhar Ray makes an intervention during the discussion on the constitutionality of introducing a Private Members’ Bill on amending the Preamble to the Constitution

Sir, I support the views expressed by Mr Anand Sharma ji and Manoj Jha ji. In the Kesavananda Bharati case, the Honourable Supreme Court said—they decided internally here, that sovereignty of Parliament is there—that the supremacy of the Constitution cannot be ruled out. So, whether it is Parliament or any other constitutional or statutory authority, they have to abide by the Constitution. The other speaker who spoke about the constitutional amendments is an entirely different case because they [the earlier amendments to the Preamble] happened long back, before the judgement in the Kesavananda Bharati case was delivered. The judgement in the Kesavananda Bharati case is still subsistent and therefore, I would request the Chair not to allow this [Bill].
