Trinamool Congress MP Abhishek Banerjee has urged the Centre and the Union Ministry of Law and Justice to take initiatives to appoint an adequate number of judges in Calcutta High Court. Banerjee is all set to raise the issue in the next session of Parliament.
Out of the sanctioned strength of 72 judges, there are only 34 functional judges. Therefore, there are 38 vacancies, or approximately 53 per cent. Taking into account retirements and routine transfers, this percentage would rise to 66 in the next six months.
Abhishek Banerjee said, “Such colossal vacancies will lead to a substantial increase in the burden of judicial and administrative work to be discharged by the existing judges, despite higher disposal rates compared to other High Courts”.
He further stated that Calcutta High Court has faced the brazen apathy and indifference of the political executive with respect to the filling up of vacancies.
Firstly, he said that the names of seven members of the Bar have been recommended by the collegium of the Supreme Court to the Central Government for elevating them as judges of Calcutta High Court along with recommendations for the elevation of judges of other High Courts a long time back. Yet no action has been taken on those recommendations.
Secondly, while the functional strength of the other High Courts has increased by the day, vacancies of judges of the Calcutta High Court have remained.
However, he further stated, an appointment of seven or some more judges, if at all, would also not bring any substantial change in the functional strength because of the ensuing retirements. He therefore urged that immediate action be taken to appoint a maximum number of judges to prevent the justice delivery system from collapsing.
The MP also observed that by adopting a step-motherly attitude a particular High Court would be rendered ineffective.

হাইকোর্টে বিচারপতির পদ পূর্ণ করতে হবেঃ অভিষেক বন্দ্যোপাধ্যায়
হাইকোর্টে অর্ধেকের বেশি বিচারপতির পদ শূন্য। এই নিয়ে কেন্দ্রের বিরুদ্ধে রাজ্যের প্রতি বৈষম্যমূলক আচরণের অভিযোগে করলেন তৃণমূল যুবনেতা ও লোকসভার সাংসদ অভিষেক বন্দ্যোপাধ্যায়। সংসদের আসন্ন অধিবেশনে এই বিষয়ে তিনি সরব হবেন বলেও জানিয়েছেন।
কলকাতা হাইকোর্টের বরাদ্দকৃত বিচারপতি পদের সংখ্যা ৭২। অথচ বর্তমানে মাত্র ২৮ জন বিচারপতি রয়েছেন। লিখিত বিবৃতিতে অভিষেক কেন্দ্রের ওই আচরণকে স্বৈরাচারী বলে দাবি করেছেন। তিনি বলেন, হাইকোর্টে বিচারপতির পদ শূন্য পড়ে থাকলে বিচার ব্যবস্থাই বিপন্ন হবে।
অভিষেকের দাবি, রাজ্যের বিচারপ্রার্থীদের হয়রানি সত্ত্বেও কেন্দ্রের সরকার উদাসীন। তিনি বলেন, এই রাজ্যের ক্ষেত্রে কেন্দ্রের সর্বোচ্চ কর্তার নেপথ্যে মদত রয়েছে। রাজ্যকে বেকায়দায় ফেলাই তাদের একমাত্র উদ্দেশ্য।
তাঁর মতে রাজ্যের শূন্যপদে বিচারপতি নিয়োগে এই উপেক্ষা আসলে কেন্দ্রের রাজনৈতিক চাল। নানা ক্ষেত্রে কেন্দ্রের এনডিএ সরকার রাজ্যের প্রতি যে বৈষম্যমূলক আচরণ করে চলেছে, হাইকোর্টের বিচারপতি পদ পূরণে অবহেলা তারই অঙ্গ বলে মনে করে তৃণমূল। কেন্দ্রের আইন মন্ত্রীর কাছেও অবিলম্বে এই বিষয়ে পদক্ষেপ করার আবেদন জানিয়েছেন।
