Derek O’Brien asks a Question on the new draft National Education Policy

Sir, the question is on RTE, so it is part of the issues discussed or put out in the public domain of the new draft National Education Policy. My question is very specific.

The Prime Minister and the Rashtrapati ji spoke in great detail about federalism, and Education is number 25 on the Concurrent List. I want to first welcome the new Education Minister. He said this is the first time he’s here. Sir, the question is also not complicated; the answer is a simple yes or no.

The draft National Education Policy was submitted and is in the public domain. There are only three days left for people to give their inquiries, so I am sure you will consider extending that.

While putting together this draft National Education Policy, it seems that zero meetings were held with the 29 State Governments – none were consulted. This is what I was told not only by the media but also by the chairperson of the drafting committee, Dr Kasturirangan. 

My question is, were there any meetings held or not with the State Governments before this National Education Policy was made?

 

Manas Bhunia speaks on the implementation of Ghatal Master Plan

Thank you, Hon’ble Chairman Sir. Today, I will take the opportunity to place my appeal, through you, to the government’s Jal Shakti Department and to the entire government.

In our State, in the district of Paschim Medinipur and Purba Medinipur, lakhs of people have been suffering recurrently due to devastating floods. As a result, the State Government came up with an important proposal to implement the ‘Ghatal Master Plan’ with the help of the Union Government. The plan was submitted to the concerned department, it was examined by the technical committee and the Ministry of Finance. It was given sanction two and a half years back.

Sir, unfortunately not a single paise has been given by the Central Government till date. As a result, the people of Paschim and Purba Medinipur – near about 20 blocks, lakhs of people – are suffering every year. Sir, I hope that you have also seen in the news media that our Chief Minister Mamata Banerjee communicated to the Central Government, our concerned irrigation Minister communicated to the Central Government, they came as well for regular discussions with appeal. But unfortunately in the FNP programme, since the middle of the 12th Plan till date, this project did not get a single paise. 

I shall urge upon, through you, the Central Government, kindly look into this matter to ameliorate the sufferings of the people of West Bengal  and give the funding which is really due from the Central Government to complete this project, so that people get relief from the suffering due to the devastating floods.

Sir, it appears from the figures given in the reply that the domestic production of coal is declining whereas the supply of imported coal is rising very fast every year, despite the series of steps claimed to have been taken by the government. My question, through you Sir, to the Honourable Minister is, what are the reasons for the decline in the domestic production of coal  and the sharp rise in the import of non-coking or thermal coal?

Sir, I would request the Minister, through you, to do more homework because what I have referred to pertains to his reply only which is printed here – domestic production is declining and import is rising.

My second supplementary is, whether the government or for that matter, Coal India Limited has initiated any plan of action ion consultation with the coal-producing States to stop the illegal mining of coal?

Manish Gupta asks a Supplementary Question on the Bharatmala 2.0 Project

There has been a delay in the project, Bharatmala 2.0. Is it because there is reluctance on the part of certain functionaries to proceed with the DPRs? This is directly affecting West Bengal. So we would like to know about the stretches in West Bengal that are envisaged within this project.

Shanta Chhetri makes Zero Hour mention on Centre’s delay in giving Scheduled Tribe status to 11 Hill communities

I would like to draw the kind attention of this august House to the matter that the West Bengal Government vide their letter dated February 28, 2014 had recommended granting of schedule tribe status to 11 communities living in Sikkim, Darjeeling and other Gorkha-dominated areas.

In consequence to this proposal of West Bengal, the Central Government had constituted a committee to examine and recommend the granting of schedule tribe status to those 11 communities. However, several years have rolled by since.

The West Bengal Government has recommended these 11 communities because they fulfil the criteria of having primitive traits, distinctive culture, geographical isolation, shyness of contact with communities at large and extreme backwardness.

There is an urgent need to bring the highly deprived communities into the mainstream. There has already been a huge delay since the West Bengal Government submitted its recommendation way back in 2014.

Sir, its my humble request to the august House to seek a detailed explanation on the delay and set up a definite timeframe within which the Central Government would approve the State Government’s recommendations and grant these 11 communities scheduled tribe status and help create equal opportunities for all, which is the constitutional right of every Indian.

অমিত শাহ, ক্ষমা চান, নয়তো আইনি প্রক্রিয়া শুরু করা হবেঃ তৃণমূল কংগ্রেস

আজ কলকাতায় বিজেপির সভাপতি অমিত শাহ এক জনসভা করেন। সেই সভায় অমিত শাহ রাজ্য সরকারের ওপর ভিত্তিহীন অভিযোগ আনেন। তার প্রতিবাদে তৃণমূল কংগ্রেসের পক্ষ থেকে সাংবাদিকদের মুখোমুখি হন, তৃণমূল কংগ্রেসের সর্বভারতীয় মুখপাত্র ডেরেক ও’ব্রায়েন।

তিনি বলেন, “অমিত শাহ আজকে বাংলাকে অপমান করেছেন, বাংলাকে অসম্মান করেছেন। বাংলার সভ্যতা, বাংলার শুদ্ধ সূচী, সুস্থ রুচি উনি বোঝেন না। এসব ওনাকে কি বোঝাব? বাংলার যে একটা সংস্কৃতি আছে, উনি সেটাকে অপমান করেছেন। তিনি ডাহা মিথ্যে দুর্নীতির কথা বলেছেন। উনি যদি ৭২ ঘণ্টার মধ্যে ক্ষমা না চান, অবশ্যই আমরা আইনি ব্যবস্থা নেব। সভ্যতার একটা সীমা থাকে, সম্মানের একটা সীমা থাকে। সেই সীমা অমিত শাহ আজ অতিক্রম করেছেন। অমিত শাহ, আপনি আগে নিজের ইতিহাস দেখুন, হলফনামা দেখুন।”

ডেরেক ও’ব্রায়েন অমিত শাহের বিষয়ে আরও বলেন, “উনি দুর্নীতির ডাকাত, দাঙ্গার ডাকাত। এইসব ধরনের রাজনীতি আগে যেখানেই করে থাকুন না কেন, এই রাজনীতি বাংলায় চলবে না। একদিনের জন্য আসবেন, বাংলাকে অপমান করে পালিয়ে যাবেন। আমাদের কাছে যথেষ্ট প্রমাণ আছে। সোজা ভাবে তৃণমূলের পক্ষ থেকে বলা হচ্ছে, হয় ক্ষমা চান, আর যদি না চান, আমরা আইনি ব্যবস্থা নেব। ”

সাংবাদিকদের প্রশ্নের উত্তরে তিনি বলেন, “এটি একটি ফ্লপ শো ছিল। মমতা বন্দ্যোপাধ্যায়ের নামে বাংলায় কোনও দুর্নীতির অভিযোগ আনলে, বাংলার মানুষ তা মেনে নেবে না। মমতা বন্দ্যোপাধ্যায়ের বিশ্বাসযোগ্যতা, মমতা বন্দ্যোপাধ্যায়ের প্রতি মানুষের আস্থা-ভরসা প্রশ্নাতীত। সেই মমতা বন্দ্যোপাধ্যায়ের ওপর দুর্নীতির কাদা ছোঁড়ার চেষ্টা করা হয়েছে।”

রাষ্ট্রীয় নাগরিক পঞ্জীর (National Register of Citizens or, NRC) বিষয়ে সাংবাদিকদের প্রশ্নের উত্তরে তিনি বলেন, “এটা শুধু বাংলার বিষয় নয়, এটা পুরো দেশের নাগরিকদের নিরাপত্তার বিষয়। আমাদের রাষ্ট্রীয় নাগরিক পঞ্জীর বিষয়ে বক্তব্য পরিষ্কার, এটা বাংলার একার ব্যাপার না, এটা রাজস্থান, পাঞ্জাব, বিহার, আসামেরও বিষয়। গোর্খা, গরীব, প্রান্তিক মানুষ, বীর সেনা, জনপ্রতিনিধিদের, এমনকি প্রাক্তন রাষ্ট্রপতির পরিবারের মানুষদেরও ঐ তালিকা থেকে বাদ দেওয়া হয়েছে। ভারতীয় নাগরিক বাঁচাও, এটাই আমাদের স্লোগান। এটা কোনও সস্তার দাঙ্গা লাগানোর স্লোগান না। কোনও দাঙ্গার রাজনীতি বাংলায় চলবে না। আমরা আমাদের সীমার মধ্যে থেকে, শান্ত-নম্র ভাবে বলেছি, আমাদের বাংলার পারম্পরিক সংস্কৃতি আমরা ধর্ম-বর্ণ নির্বিশেষে মেনে চলি। আজ অমিত শাহ তাঁর সীমা ছাড়িয়েছেন।”

Nadimul Haque speaks on The National Sports University Bill, 2018

Respected Chairman Sir, thank you for allowing me to speak on this Bill, which seeks to establish and incorporate a National Sports University in the state of Manipur. The significance of sports and fitness in life is priceless. A healthy sports culture leads to an equally healthy society. Sir, sports is a very important and valuable field for the development as a nation as whole which perhaps till now hasn’t been given the importance it was owed.

Sir, ‘Yahan patthar ki imarat ugai kaise? Yahan patthar ki imarat ugai kaise? Jis jagah khel ka maidan hua karta tha.’ Sir, this university will aim to fulfil the void in the sports environment of the country. The Bill raises a few questions and concerns particularly Clause 7. It is pertinent that the university should have autonomy over its functioning and the matters relating to it. Sir, the department of sports should ensure that this provision be in line with other major universities and should not hamper the autonomy of this university.

Sir secondly, Clause 30 of the Bill provides that there should be a university bill for contributions, grants, loans etc. This will provide for the amount received in any other manner from any other source. This will cover any contribution which has not been specifically mentioned in other sub-clauses.

Sir, going into the merits and demerits of the Bill, I have two suggestions. First of all, the NSU should collaborate with premier national institutions like the IITs, IIMs and other such institutes. Sir, since the university will be targeting students, sportspersons, faculties, experts, not only from the country but also from abroad, and since it is being situated in the north east, I request the government that suitable measures be taken by the ministry and the concerned agencies with regards to travel facilities and concessions which can be made.

Next, Sir, the major component of the ‘Khelo India’ scheme is identifying talent and developing them. The NSU should be of immense assistance to the ministry in prescribing procedures and standards for talent identification. The university should be able to generate its own resources to meet or supplement its requirements. In addition to the position made in the Bill under Clause 30, other resources like reaching out to corporate sources under CSR should be allowed, Sir. The outlying campuses could be established in specific regions in the country, which are hubs for specific sports. For example, for wrestling, Haryana is famous; for hockey, Punjab is famous. So. these outlying campuses could be established. Sir, the university should also provide online education for persons living in the rest of the country.

In conclusion, the university should provide a boost to sporting activities in the country and also improve the country’s sports performance at the national and international level and assist in talent identification and development also considerable employment generation opportunities. The Bill is secondly a step towards bringing the nation together to make India a sporting power.

With this, Sir, I commend the Bill to the House and support it.

Manish Gupta speaks on The Negotiable Instruments (Amendment) Bill, 2018

Madam Chairman, I stand to support this Bill. I think in the middle of what is happening in the country today, we need to forge and understand new laws, so that, the future of our economic activity is not endangered by persons who have malafide intentions. In this respect, I think this particular Bill will serve the purpose to a certain extent. I don’t think that this Bill will have any great impact on the present situation, except as a step towards further improving the entirety of the problems.

Clause 2 of the Bill introduces Section 143 A, but it identifies two situations. One is the summary trial and other is the summons case. Now, Section 143 also gives power to the courts, to provide for 25 per cent to the complainer, while the case is in progress. A question has been raised, as to how the government arrived at this 25 per cent. It is a very arbitrary figure, and is a very cautious approach. What we need here is a bold approach and 25 per cent, I don’t think will have the desired effect. A much higher amount – like 30 or 40 per cent – would have given a decent incentive to people who issue cheques, which bounce in the banks.

It is very important to identify the causes of delay in the courts. We make laws, we bring up new legislations, but the general situation in delay in the courts has not been substantially solved. Today there are more than 30 lakh cases pending in the subordinate courts, and 35,000 cases are pending in the higher courts. Nobody has calculated when these decisions of the courts or convictions will be handed down, will be appealed again in the higher courts, so that means more time will elapse before justice is done.

However a silver lining is, that, recently in the Economic Survey, there is a chapter on justice delivery and courts. There is thinking in this regard that Our laws on dispute resolution can only be affected as the dispute resolution process themselves. Therefore, it is of utmost important that any legislation that the parties, who are involved in the dispute, must one way or the other be assured that their rights will be enforced in the court in the reasonable time.

The role of banks is important. RBI as the Central Bank has a very important role to play, although they are not involved in the court processes. The RBI’s recent track record indicates, as they have said, they don’t have adequate powers to deal with public sector banks. They have issued new guidelines for state’s assets in all the sectors – cement, power etc.

But the Central Bank cannot absolve itself of being more proactive. The people of India look up to the Reserve Bank. The Reserve Bank promulgates banking regulation. Banks charge Rs 300 for every representation of any bounced cheque. Reserve Bank needs to get more involved. New guidelines are unimaginative. The same guidelines have been recommended for many sectors. But each sector of economy has its own problem. This situation needs to be looked at more closely; even application of Section 421 of the CRPC. So all this will come into play when this Act is applied.

Therefore, although we support this legislation – it’s a step in the right direction – the government must keep on thinking as to what more they can do for the future.

Sir, all the Opposition members spoke. everyone has expressed themselves. There is an issue here on the quality of person who will be appointed. I don’t think anyone in the Opposition is suggesting that the post be left vacant. Nobody is suggesting that. The question is, do we have a professional who understands the issue. That’s all.

If the minister has changed the rules of the Bill, he must be congratulated for it. But, he has changed the rules, not the Act. What has caused a concern, is that we are doing legislation not for one person.

In the spirit of what you suggested, Sir, may I with your permission, Sir, through you, suggest to the House, that this is an issue which can be resolved. There are just two issues. We all want a qualified professional to be there. After that, we can resolve this issue by discussion.

Derek O’Brien speaks during a Calling Attention Motion on misuse of social media and fake news

Sir, regarding this Calling Attention Motion, I have four specific questions to the minister and I hope he will answer that. Bur before that I have 3 sentences.

It is the party which came to power in 2014 which created the culture of digital mobs.

It is the party which came to power in 2014 which is trying to condition minds.

It is the party which came to power on 2014 which has made fake news into its master hobby.

I have four specific questions and all I ask for are the answers at the end of this debate. What did the minister not tell you in his so-called comprehensive review? He didn’t tell you which is the largest Facebook platform which was brought down by Facebook. And that page was called ‘Postcard News’. Look at the content of ‘Postcard News’. It is 100% right wing/RSS/BJP content.

(When did RSS become unparliamentary, Sir? I didn’t mean to hurt anyone. In my book it means Rumour Spreading Society.)

My first question: If Postcard News was brought down, why are BJP MLAs, MPs and ministers now demanding from Facebook that it should be brought back. Why?

My second question: One of India’s most vile, bilious, hatred-spreading Twitter handles is @IPPatel. Why was he called to the BJP President’s social media network meet last week?

My third question: Minister, if these big WhatsApp groups are creating all these problems – and you are right they are creating all these problems – please get WhatsApp to disclose to you at least 1,000 such groups and it will be very useful to you to find out who they are.

My fourth question: It is on Facebook. Facebook’s largest advertiser in India today, with 19 sponsored ads in the last six months, is ‘Nation with Namo’. My question is, who is paying for this?

Sir, I’m only concluding with one sentence. Sir, if I’m not making a relevant point I can sit down, if you want me to, but the four questions I’ve asked, I want the answers to those. Because, I believe and the Trinamool Congress believes, that digital India is really divisive India.
