Manas Bhunia speaks on The Insolvency and Bankruptcy Code (Amendment) Bill, 2020

Honourable Deputy Chairman Sir, the Honourable Finance Minister has brought this Insolvency and Bankruptcy Code (Amendment) Bill, 2020. I personally feel it is a compulsive stand of the Government to bring this Bill because the space and time of the Ordinance is lapsing. But I am confused. The Honourable Member was appreciating the Government for the recurrent, repeated Amendments to rectify the stand of the Government. But does it not show the hesitance and haziness of the Government, in knowledge and application, to enable this Bill to enact properly the IBC code?

Sir, I understand that since 2017, three times Ordinance have been brought and four times, Amendments to rectify this Act. Does it now show the confused attitude of the Government, lack of knowledge, lack of proper interpretation and lack of proper implementation on this subject?

Sir, the Honourable Member rightly raised the case of MSME. The sector will die if the businesses are not protected, considering MSME is the pillar of the economic structure of our country, as industrial production is going down, down, down. Agriculture is in the doldrums. Mining and manufacturing are facing a serious, critical situation. When the entire country and economy is reeling under crisis, this IBC Bill, reflective of the Government’s compulsive attitude, was again brought to this august House.

So the question of goods and service, for the survival of the MSMEs, should be the Clause 5 and should be examined with proper attention by the Honourable Finance Minister. At the same time, in the case of real estate, which is Clause 3, the aggregation of home buyers should be looked into. How can home buyers be aggregated, as then they will have to run from pillar to post? Individual buyers have to be called to please come so that their association can be formed, and there has to be a minimum of 100 buyers for proceeding for resolution. How can it be so? Is it not the responsibility of the Government to protect the home buyers from the attitude and stand taken by the realtors? So the attitude of the Government is a central point and it is confusing as to whether it is interested in protecting the buyers or the realtors or both of them. We are not clear.

Sir, so many cases are filed with the NCLT. Till date, 10,860 cases are pending. There is no attempt to open more NCLTs in the country, as a result of which the pendency of the cases is increasing and resolutions are not being properly done. The people who have gone to the appellate authority are not getting justice.

In such a situation, I feel that this Bill is about the compulsive attitude of the Government. It is in a hazy state of mind when the economy is in a critical situation and when we are talking about coronavirus, pandemic situation, World Health Organisation advisory, the Government of India advisory. The Finance Department, in my opinion, has been totally engulfed by the financial coronavirus.

 

Manas Bhunia speaks on the Centre’s duty to help States reeling under debt burden

Sir, I want to draw the attention of the Honourable Finance Minister and the Prime Minister, through you, to the fact that certain States in our country are debt-trapped and debt-barred. West Bengal inherited the debt burden from the 34-year rule of the Left Front, a burden to the tune of Rs 2,03,000 crore. Initially the State Government.s mop-up resource was Rs 22,000 crore, now it has reached Rs 52,000 crore under leadership of Mamata Banerjee.

My submission is that this State is reeling under the debt trap crisis. The Central Government should come forward to approve and extend all possible help and consider a moratorium for the sake of the State’s development and economic upliftment. Under the leadership of Mamata Banerjee, we are trying our best to improve the economic condition through all-round development.

I urge the Government, particularly the Finance Minister, through you, Sir, to consider the situation of West Bengal, along with that of other debt-trapped States, and provide moratorium at this moment. Thank you, Sir.

Manas Bhunia speaks on the lack of amenities in railways quarters in Kharagpur

Sir, I want to raise one important issue. Through you Sir, I want to attract the attention of the Hon’ble Railway Minister.

Sir, in our state, Kharagpur railway town is called ‘Mini India’ where 30 percent of the Telugu population resides. Tamil, Kannadigas, Malayalis, Odia, Bihari, Chhattisgarhi, UP, Bengal, and also Assam reside here – it is really a ‘Mini India’. It is one of the very important rail towns with the longest railway platform in India – Kharagpur. 

Very unfortunately Sir, recently, water is not properly served to the railway quarters, railway ‘basti’ areas and nearby adjoining areas. Sir, there is a powerful municipality working in Kharagpur town, an elected body. Several times the municipal authorities have approached the divisional authorities of Kharagpur, including South Eastern Railway headquarters at Garden Reach. Kindly allow us to work with railway administration. They wanted to extend their full cooperative hands for construction of roads in the ‘basti’ area, to provide the drinking water facility, for lighting and a sewerage system. 

Sir, recently as per a report, sweepers who are in charge of cleaning the areas do not have personal latrines. Such things should be intervened by the Hon’ble Railway Minister and I want to appeal through you Sir, it is my earnest appeal to the Railway Ministry that they should send a high powered delegation or administrative team to the Kharagpur area and find out the provisions whether the local railway authorities can work along with the Kharagpur Municipality in a positive mode to uphold the demands of the railway staff, workers and the people living in the ‘basti’ area particularly.

It can be a beautiful system if there is an MoU signed between the Kharagpur Railway Authority and the Municipal Authority. Then all the problems can be solved with the help of the Railway Ministry and the State Government. This is my appeal to you, Sir.

Manas Bhunia speaks on the implementation of Ghatal Master Plan

Thank you, Hon’ble Chairman Sir. Today, I will take the opportunity to place my appeal, through you, to the government’s Jal Shakti Department and to the entire government.

In our State, in the district of Paschim Medinipur and Purba Medinipur, lakhs of people have been suffering recurrently due to devastating floods. As a result, the State Government came up with an important proposal to implement the ‘Ghatal Master Plan’ with the help of the Union Government. The plan was submitted to the concerned department, it was examined by the technical committee and the Ministry of Finance. It was given sanction two and a half years back.

Sir, unfortunately not a single paise has been given by the Central Government till date. As a result, the people of Paschim and Purba Medinipur – near about 20 blocks, lakhs of people – are suffering every year. Sir, I hope that you have also seen in the news media that our Chief Minister Mamata Banerjee communicated to the Central Government, our concerned irrigation Minister communicated to the Central Government, they came as well for regular discussions with appeal. But unfortunately in the FNP programme, since the middle of the 12th Plan till date, this project did not get a single paise. 

I shall urge upon, through you, the Central Government, kindly look into this matter to ameliorate the sufferings of the people of West Bengal  and give the funding which is really due from the Central Government to complete this project, so that people get relief from the suffering due to the devastating floods.
