Reaction of Trinamool Congress to Amit Shah being discharged in ‘Fake Encounter Case’
This case is a complete travesty of justice. It would have gone to trial. Hopefully, after appeal, it will go to trial.
IPC Section 161 statements made by builders state that they had given money to Amit Shah.Amit Shah’s defence did not even disagree. They said that yes he may have taken money but it was extortion, it was not linked to the encounter case.
If Tulsiram Prajapati and Sohorabuddin had been killed at the behest of the builder lobby which is being widely proven, why would the builder lobby would have paid Amit Shah if it was not for the encounter case?
If the call detail records in possession of CBI are looked upon, it clearly shows that Amit Shah, the Home Minister of Gujarat, was heard speaking with mid-level, junior-level police officers. That is not what a Home Minister does. The defence said that after the Gujarat riots, he was a very hands-on Home Minister, but even if you are a hands-on Home Minister, is it purely coincidental that you would be speaking junior, mid-level officers who were involved in the encounter.
If you look at this particular trial, what happened? The prosecutor was change, then the judge asked Amit Shah to appear in court. The minute he did that, he was transferred. After that, the judge who took over, passed away last month of a heart attack at the age of 52, completely unexpected. The current judge, who passed the order only took charge on 4th of December. How can a judge take charge on the 4th of December and pass the order today on 30th of December? What was the hurry?
Solanki, who was the investigating officer of the case has given a 161 statement saying that Geeta Zaveri and Ajay Chowthal, police officers, had a meeting with Amit Shahin which Amit Shah said that how could Solanki, who is a junior police officer write a negative report on Amit Shah and the report should be changed. Geeta Zaveri, who is a co-accused has given a statement implicating Amit Shah. Now, normally, if a co-accused has given a statement implicating somebody, then at least the case should go to trial. There is enough merit in the circumstantial and direct evidences that show that the case should go to trial, but how is the discharge coming in?
There can be no clearer case that the CBI being manipulated by the Center than this.
