Saugata Roy’s speech on Chartered Accountants, Cost & Works Accountants & Company Secretaries Bill

Sir, I rise to speak on the Chartered Accountants, the Costs and Work Accountants and Company Secretaries
(Amendment) Bill, 2021. This Bill was brought to Parliament in December, 2021. It was referred to the Standing Committee of which Mr. Jayant Sinha was the Chairman and of which I also happen to be a Member. The Standing Committee has by and large endorsed the Bill. But the Standing Committee mentioned certain things which the ultimate Bill has not followed. What is it? The Standing Committee mentioned that the autonomy of these institutes should not be hampered. Yes, regulation is to be ensured but in making regulations, you should not throw out the baby out with the bathwater and that is what has happened. The bureaucrats in the Ministry of Corporate Affairs have increased their stranglehold on these three independent professions through this Bill. Why? Now, they are saying that there will be a Coordination Committee consisting of three types of professionals – chartered accountants, cost accountants and company secretaries – and it will be headed by the Secretary, Ministry of
Corporate Affairs. The Bill aims at bringing discipline to the professions but the Disciplinary Authority will be headed by a non-chartered accountant. And the Disciplinary Committee would have more non-CA members than CA members. Sir, this is what this Government is doing generally. Earlier, there was an elected Medical Council of India. They dismissed that. Now, they have got National Medical Commission, all appointed people. They want to take away the power of all professional bodies. First, they take away the power of medical profession. Then, slowly they will also take away the powers of the Bar Council. This Government is taking away the powers of the professionals. I do not say that these professions are perfect. We all know that Chartered Accountant Institutes purposely limit the number of pass-outs. If the pass-outs are less, then the scope of jobs is more. I do not know of any Chartered Accountant who is unemployed. The Chartered Accountants sign everything starting from balance sheet of
schools, NGOs, companies. The hon. Prime Minister mentioned that `your signature‍िis‍िmore‍िimportant‍िthan‍िours’‍िbecause‍िif‍िthe Chartered Accountants sign the balance-sheet of a company, then the document becomes sacrosanct. The Chartered Accountants have not been ideal in this respect. We all know of the incident of the Satyam Computers, a very famous audit firm of India was engaged in auditing their accounts. Satyam was showing its shares at an inflated value. It was found that it was a total wrong-doing of the Chartered Accountant firm. Recently, ILFS were also caught with their hand in the till. In that incident also it
was the failure of the Chartered Accountants. I know that there is a need to control and bring in some discipline amongst the Chartered Accountants, but it cannot be ensured by giving more powers to the Ministry of Corporate Affairs. The mechanism within the professions has to be strengthened. There was a recommendation of the Standing Committee in this regard. The Government has not gone by the recommendations made by the Standing Committee. The Standing Committee very specifically said, Shri Jayant Sinha said that we should not take away the autonomy of this institute. Why have the Government taken away the autonomy of this institute? It is alright to bring in some small changes like increasing the term of the Council from three years to four years; the penalties can be enhanced; there could be fines imposed in case of misconduct. So, this amendment has become self-defeating. Of course, I know that Chartered Accountants have great lobbies. Earlier also such a Bill was brought forward but they lobbied hard requesting not to put much restrictions on them and they were successful then, but in order to control their lobby this is not the way. The Parliamentary panel has said that the Government should consider setting up an
Indian Institute of Accounting akin to IITsand IIMs across the country for enhancing the development of accounting and finance profession. That is a good idea but the Government has not accepted this recommendation. The Parliamentary panel also suggested that multiple bodies, as is the norm in advanced nations, are required
to promote healthy competition for raising the standards and improving the credibility of financial reporting and auditing in the country. The Prime Minister himself said that the signature of a Chartered Accountant is more important than that‍िof‍िthe‍िPrime‍िMinister.‍िSo,‍िhe‍िproposed‍िwhat‍िis‍िalready‍िthere‍िin‍िthe‍िCompany’s‍ि

(Interruptions) That is why I say, as Shri Raja suggested, that we must have a special Committee on this Report of the Standing Committee because the Report of the Standing Committee has not been followed. The Government has been intent in its purpose of increasing the stranglehold of the bureaucracy of the Ministry of Corporate Affairs on the independent profession of chartered accountancy. This is not to say that chartered accountants do not help in setting up shell companies. This is not to say that they are at many times complicit in the acting of the firms, especially the shell companies. But this is also to say that the choice is not between the baby and the bath water. You cannot throw out the baby with the bath water. So, I urge upon the Government to please give some independence and some autonomy, improve the disciplinary mechanism by all means, and bring in people from outside to judge the chartered accountants. I do not agree with this theory of domain knowledge that only chartered accountants can deliberate on the misdeeds of chartered accountants, if there are. Non-chartered accountants can also deliberate on them. With these words, I will again recommend to the Government to have a fresh look, instead of going by the Report of the bureaucrats of the Ministry of the Corporate Affairs.

Sajda Ahmed’s Zero Hour mention on improving the digital infrastructure for educational purposes

Hon. Chairperson, Sir, thank you for giving me the opportunity to speak. The COVID pandemic has taught us an additional feature, that is, the use of digital technology in the education system. To some extent, we have developed
digital education. But still, the household disparity in accessing digital world and internet, is a huge challenge. The Government has been proclaiming digital schemes for other sectors but in the education sector, digital initiatives are being overlooked. Protecting the digital infrastructure and investing in the digital infrastructure in education are vital for economic growth and for reducing income inequality. Thus, to gain the benefits of demographic dividend, proper investment in building digital infrastructure in the field of education is the need of the hour. I urge upon the Government to build up the digital sub-structure keeping in mind the future challenges in education, particularly in the rural areas.

Santanu Sen’s Special Mention on the impending hike in prices of essential drugs from April 2022

Sir, the prices of essential medicines, including pain killers and antibiotics, are set to go up from April, 2022, with the Government allowing an increase of over 10 per cent for the scheduled drugs. India’s Drug Pricing Authority, on 25th March, allowed a price hike of 10.7 per cent for the scheduled drugs which are under price control. This is the highest price hike allowed. Over 800 drugs, under the National List of Essential Medicines (NLEM), will see a price rise from April and even few drugs in this List are used for severely ill Covid patients. The Indian pharmaceutical manufacturers urged our Government to allow this price hike. But, it will be a huge burden to the common people at large. As unlike Bengal, patients need to purchase almost all the medicines prescribed and there is no “Fair Price Medicine Shops” concept anywhere outside Bengal, many patients will be forced to discontinue their courses
due to price hike leading to serious health hazards which will be a burden as a whole to our nation too. The Government must take up this issue seriously.

भाव 79 रुपयेसे 130 रुपयेहो गया है। सर, मेरा यही सवाल हैिक जब सब चीज़ȗ क दाम बढ़ रहेहȅ, पिÅलक महंगाई की मार सेपरेशान है, तो पिÅलक कहां पर जाए, अपनी पीड़ा लेकर िकसके सामनेरोए? सर, िपछली बार जब कैरोसीन के दाम बढ़े थे, तब एक ĢÌन के जवाब मȂ
माननीय िवDŽ मंतर्ी जी नेकहा था िक हम कैरोसीन को फेज़-आउट करȂगे। सर, यह गरीब आदमी की जरूरत है, यह गरीब आदमी के िलए Äयूल है, अगर इसको फेज़आउट करȂगे, तो उसके िलए क्या करȂगे? सर, एलपीजी, सीएनजी और गैस िसलȂडर
के भी तो दाम बढ़ रहेहȅ। जब इनके भी दाम बढ़ रहेहȅऔर कैरोसीन के भी दाम बढ़ रहे हȅ, तो येगरीब लोग कहां जायȂगे? सर, मȅआपका ज्यादा वक्त नहीं लूंगा और एक बात कहकर अपनी बात समाÃत करूं गा। मȅआपको एक शेर सुनाता हूं, “िहन्दू-मुिÎलम-िसख-ईसाई सारेके सारे, थक गए हȅलोग महंगाई के मारे।” सर, बहुत-बहुत शुिकर्या ।

Santanu Sen’s speech on The Appropriation Bill, 2022 and The Finance Bill, 2022

Sir, standing on behalf of the propeople and pro-poor people party, the All India Trinamool Congress, I was
listening to my BJP colleague talking about poor; sitting in a country where we are having more than 800 million real poor people, ∗ Now, I will be citing some examples to state the real facts. Sir, in the last seven days, 22nd to 28th March, petrol and diesel price hike took place seven times, altogether of Rs.4 per litre on petrol and Rs.4.10 per litre on diesel. Is it not against the interests of the poor? This country is selling out the profitable PSUs. They are more
interested in getting the revenue out of the fuel. Is it not against the interests of the poor? In 2014, the excise on petrol per litre was Rs.9.48; it has come in 2021 to Rs.27.90. There is an increase of 211 per cent. Is it not against the interests of the poor people of this country? : The excise duty on diesel per litre in 2014 was Rs.3.56, which became Rs.21.80 in 2021, with an increase of 633 per cent. Is it not against the interests of the poor people? So far as LPG is concerned, in 2021, the price was Rs.770. In one year, it has become Rs. 950. There is an increase of 23 per cent. Is it not against the interests of the poor people? Sir, the people are forced to use kerosene. Let me tell you the fact, in 2021, per litre kerosene was Rs.22 and in 2022, it has become Rs.45, there is an increase of 101 per cent. Is it not going against the interests of the poor people? Then, I come to domestic edible oil. I think, our learned Union Ministers, they all are practising oil free diet. That is why they have increased the price so much. In March, 2022, it was Rs.125 per litre and in one month, it has become Rs.180 per litre. There is an increase of 52 per cent. They are
forcing all of us to have oil-free diet. Sir, retail cereals, fruits, vegetables, food, there is an inflation which has driven up to 5.4 per cent by January, 2022. Fuel price for bulk users has been hiked by Rs.25 per litre. Jet fuel price has been increased by 18.3 per cent on 16th March. Sir, the sky rocketing of fuel prices will cause a further pressure on India’s worsening inflation. In January, 2022, the retail inflation rate in India crossed the RBI’s threshold limit of 4 plus 2 per cent touching a whopping 6.01 per cent. Sir, the Wholesale Price Index which is the main measure of inflation has also been in double digits for the last few months. It has become 13.11 per cent when the market perception was that it can be maximum up to 12.1 per cent. The problem is, our present Government, they are gradually forcing us towards the Mesolithic age.They are gradually forcing us to adopt the practice of using wooden logs, work on the road, eat raw vegetables and go for hunting to earn our food. That is what they are trying to do so. They are setting the poor’s kitchen into the fire and they are talking about the poor people. India has never witnessed such anti-poor people Government in the history since Independence. And, I strongly believe that the
Government should take up the issue very seriously because the poor people are crying. Otherwise, people are making their mind to give a befitting reply in due course of time. Thanks for giving me time, Sir.

Jawhar Sircar’s Supplementary Question on a road map to give a momentum to the economy of India

Sir, my question is, where is the answer to the question. The question was: Where is the roadmap? You have answered it in bits and pieces — a brick here and mortar there. Where is the answer? Where is the roadmap? Where is the investment? Yes, I admit, you have mentioned about infrastructure. I do agree. You have mentioned about PLI. But these are small bits. We are talking of an economy, that is, of Rs.150 lakh crore. Whatever you do …(Interruptions)…  I know time is running fast. My question to the hon. Minister is, please work it out and give us a roadmap. Your Budget has outlined certain small steps put together. But we need a big map. Are you willing to tax the rich?

Derek O’Brien’s Supplementary Qs on CGHS services for retired military personnel, senior journalists

Sir, my question is on the Central Government Health Scheme. The hon. Minister has answered paying of bills is a
continuous and dynamic process. So, since the Minister of State for Health is a lady, I was wondering whether as a part of this continuous and dynamic process, she actually convinces his male colleagues to make all these cards
in the name of the woman of the house. My supplementary question is this. There are many reports that 175
health care organizations are refusing to honour and clear the CGHS bills of ex-servicemen. It is my question and humble appeal as well, what steps the Minister is going to take so that the medical bills of ex-servicemen are
honoured.

Santanu Sen’s Question on suitable measures to control dengue, chikungunya and COVID-19

Sir, while discussing Dengue, Chikungunya and COVID, by now, you all know that these are multi-system diseases. The cause, prevalence and handling modalities of these diseases are not same in all States. So, Sir, through you, my supplementary to the learned Minister is: Why don’t we give due importance to cooperative federalism and instead
of imposing any Central directive, why cannot we speak to States individually, so far as individual diseases are concerned, and take necessary steps accordingly?
